The initiative, which is similar to Proposition 73 -- one of a
slate of Gov. Arnold Schwarzenegger-backed ballot initiatives
defeated by voters in last year's special election -- would prohibit
an abortion for a minor until 48 hours after her parent or legal
guardian was notified. Exceptions include medical emergencies or in
cases when such notification would not be in the "best interests" of
the minor. That could include cases where there is evidence of
parental abuse, and the measure allows for court-issued waivers in
such situations. It also allows for waivers if the minor is deemed
mature enough so that parental notification isn't believed to be
necessary.
